RETURN & REFUND POLICY

This Return & Refund Policy applies to purchases made from Studio96 Watches through studio96watches.com and forms part of the contractual terms governing each order. Studio96 is a trading brand operated by Modhousewatches di Lorenzo Cinciripini. Nothing in this Policy limits or excludes rights that cannot lawfully be waived under applicable consumer law.
1. Product and order classification
Studio96 watches are produced on an order-driven basis. Depending on the order, component availability, production capacity and fulfilment arrangements, a watch may be assembled and/or fulfilled directly by Studio96 or by selected production, assembly or logistics partners operating to Studio96 specifications and quality standards.
Studio96 currently offers a curated configurator built around 96 core design combinations, with additional branding choices such as logo colour. Studio96 may also display pre-designed configurations, including named or featured models, which may be purchased as presented or opened in the configurator and modified before checkout.
For contractual and evidentiary purposes, the configuration recorded at checkout - including the selected case, dial, logo colour, hour/minute hands, seconds hand and any paid add-ons - forms part of the agreed product specification.
Where Studio96 in the future offers genuinely bespoke, off-menu or clearly personalized products, such products may be subject to different cancellation or withdrawal rules where permitted by applicable law. Any such exclusion will be communicated clearly before the order is placed.
2. Faulty, damaged, incorrect or non-conforming items
If a watch arrives damaged, defective, materially different from the agreed configuration, or otherwise does not conform to the contract, please contact Studio96 promptly at info@studio96watches.com and provide the order number together with clear photographs and, where relevant, a short video showing the issue.
Studio96 may request additional reasonable evidence, packaging photographs, configuration screenshots, delivery records, or return of the watch for inspection. Evidence requests are intended to identify the issue and determine the appropriate remedy; they do not reduce mandatory statutory rights.
Where a lack of conformity is confirmed, Studio96 will provide the remedy required by applicable law. Depending on the circumstances, this may include repair, replacement, price reduction or refund. Where return of a genuinely defective, damaged or incorrect item is required, Studio96 will bear reasonable return costs to the extent required by applicable law.
Normal characteristics of a mechanical watch - including permitted movement accuracy variation, normal rotor noise, minor differences in color perception caused by lighting, viewing angle, display calibration or reflective surfaces, and characteristics expressly disclosed on the product page - are not by themselves evidence of a defect.
3. EU/EEA statutory right of withdrawal
Where the mandatory EU/EEA right of withdrawal applies, a consumer may withdraw from an eligible distance purchase within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the consumer must send Studio96 an unequivocal statement before the withdrawal period expires. This may be done by email to info@studio96watches.com. The model withdrawal form at the end of this Policy may be used but is not mandatory.
A return authorization or RMA number may be issued to simplify identification and inspection of the parcel. Failure to request an RMA does not, by itself, invalidate a statutory withdrawal that was otherwise exercised correctly and on time.
4. Configurator orders and pre-designed Studio96 models
Studio96 distinguishes between (a) pre-designed Studio96 configurations purchased as presented, and (b) configurations created or modified by the customer using the Studio96 configurator.
Because the current Studio96 configurator uses a defined set of standard pre-set options offered to the public, use of the configurator alone does not automatically remove a mandatory statutory withdrawal right where such a right applies.
However, the exact configuration selected and confirmed at checkout remains binding as the agreed specification. A change of preference after delivery - for example preferring another dial, hand set, case finish or logo colour - does not make a correctly supplied watch defective or incorrectly described.
If Studio96 later offers a product that is genuinely made to an individual specification outside the standard public options, or is clearly personalised for a particular customer, Studio96 may apply the statutory exception for made-to-specification or clearly personalised goods where lawful. Any such treatment will be identified clearly before purchase.
5. Return condition and customer handling
A consumer exercising a statutory withdrawal right may inspect and handle the watch only to the extent reasonably necessary to establish its nature, characteristics and functioning, comparable to the examination that would normally be permitted in a retail store.
Studio96 watches are ordinarily supplied with transparent protective films on relevant surfaces. Customers are strongly encouraged to inspect the watch carefully before removing those films because removal may expose polished or brushed surfaces to scratches, marks or other loss of value.
Removal of protective films does not automatically cancel a statutory right of withdrawal. However, where handling, wear, film removal, bracelet sizing, scratching, marking, alteration or other use goes beyond what is reasonably necessary to inspect the product and causes a reduction in value, Studio96 may hold the customer responsible for that diminished value to the extent permitted by applicable law.
When returning a watch, customers should return all items supplied with the order, where applicable, including:
· the watch and bracelet;
· the original box or presentation packaging;
· the bracelet/link-removal tool, if supplied;
· cards, documents and other accessories supplied with the order; and
· any separately purchased components or add-ons that form part of the return.
Missing or damaged packaging or accessories will not automatically defeat a mandatory statutory withdrawal right, but any demonstrable reduction in value caused by the customer's handling or failure to return supplied items may be taken into account where legally permitted.
6. Return shipping for non-defect withdrawals
For an eligible non-defect return made under the statutory right of withdrawal, the customer is responsible for the direct cost of returning the goods, unless Studio96 expressly agrees otherwise or applicable law requires Studio96 to bear that cost.
Returns should be sent using a tracked shipping service. Studio96 strongly recommends adequate insurance because the customer remains responsible for the return shipment until the goods are received by Studio96, subject to any mandatory rules to the contrary.
Customers returning goods from outside Italy must complete all customs and carrier documentation accurately. The parcel should be clearly identified as a returned merchandise shipment where the carrier/customs procedure permits. Studio96 will not be responsible for charges caused by inaccurate, incomplete, misleading or unlawful customs declarations made by the sender.
For non-defect returns from outside the EU, any unavoidable import, clearance, handling or similar charges attributable to the return may be deducted from a discretionary refund where lawful and where those charges are not Studio96's responsibility. This does not apply where mandatory law requires Studio96 to bear the costs, including qualifying defective or incorrect goods.
7. Return address and procedure
Before sending a return, contact info@studio96watches.com with the order number and the reason for return. Studio96 will provide the current return instructions and, where appropriate, a return authorization reference.
Unless Studio96 provides different written instructions for a particular case, returns are handled through Studio96 in Italy. Customers should not send returns to production, assembly, logistics or fulfilment partners unless specifically instructed in writing.
Studio96 may refuse delivery of parcels sent to an unauthorized address, sent cash-on-delivery, or carrying charges that the customer was responsible for and that were not agreed in advance, to the extent permitted by law.
8. Refund timing and method
For a valid EU/EEA statutory withdrawal, Studio96 will reimburse amounts due within the period required by applicable law. Studio96 may withhold reimbursement until the returned goods have been received or until the customer supplies evidence that the goods have been sent back, whichever occurs first, where legally permitted.
The reimbursement will include the price paid for the returned goods and, where required by law, the cost of the least expensive standard delivery option offered for the original order. Any additional amount paid for express, premium or upgraded delivery is not refundable beyond the standard-delivery amount where the law permits.
Refunds are normally issued to the original payment method. Banks, card issuers and payment providers may require additional processing time after Studio96 has submitted the refund.
Where a lawful deduction for diminished value or another permitted adjustment is made, Studio96 will explain the basis of the deduction.
9. Voluntary and non-statutory returns
Outside any mandatory statutory return or legal-guarantee right, Studio96 is not required to accept a return merely because the customer has changed their mind, prefers another configuration, no longer wants the watch, or considers the appearance different from their personal expectation where the supplied watch conforms to the agreed specification.
Studio96 may nevertheless offer an exchange, store credit, repair, partial refund or other goodwill solution on a case-by-case basis. Any goodwill remedy is voluntary, does not constitute an admission of fault, and does not create an obligation to provide the same remedy in another case.
10. Exchanges
Where an exchange is not required by law, exchanges are offered only at Studio96's discretion. A customer requesting a different case, dial, hand set, logo colour or other configuration after receiving a correctly supplied watch may be required to return the original product at their own cost and may be responsible for any price difference, production cost or other amount agreed in advance.
11. Cancellation before dispatch
Because Studio96 orders may enter component allocation, assembly, testing or fulfilment shortly after checkout, customers should contact Studio96 immediately if they wish to cancel or change an order.
Where a mandatory statutory withdrawal right applies and the customer's communication clearly exercises that right, Studio96 will treat the request in accordance with applicable law. For orders or circumstances where no statutory cancellation or withdrawal right applies, cancellation or modification after production has begun may be refused or accepted only on terms agreed in writing.
Studio96 cannot guarantee that a configuration, address or other order detail can be changed after the order has entered production or fulfilment.
12. Inspection and evidence
Returned watches may be photographed, video-recorded and inspected on receipt. Studio96 may compare the returned condition against order records, configuration data, production/QC records, pre-dispatch photographs where available, carrier records and customer communications.
An internal inspection assists Studio96 in determining whether a reported issue is a defect, transport damage, normal product characteristic, customer-caused damage, excessive handling or another cause. An internal inspection does not override mandatory consumer rights or prevent the customer from providing additional evidence.
13. Refused delivery, unclaimed parcels and incorrect addresses
Refusing delivery, failing to collect a parcel, refusing lawful customs/import charges, or providing an incorrect or incomplete address does not by itself create an automatic refund entitlement.
Where a parcel is returned to Studio96, any refund or reshipment will be assessed after the parcel is actually recovered and, where appropriate, inspected. For situations caused by the customer, Studio96 may deduct or require payment of reasonable shipping, return, customs, handling or reshipment costs where lawful. Mandatory consumer rights remain unaffected.
14. Payment disputes and chargebacks
Customers are encouraged to contact Studio96 before starting a payment dispute so that the issue can be investigated and documented. A chargeback or payment dispute does not create an independent refund entitlement where the contractual or statutory conditions for a refund have not been met.
If a dispute is filed, Studio96 may provide the payment provider or card network with relevant evidence, including the order confirmation, recorded configuration, payment record, tracking and delivery information, return records, inspection evidence, production/QC documentation and customer communications.
15. Mandatory consumer rights and international orders
Studio96 sells internationally. Consumer rights differ by country. This Policy applies subject to any mandatory consumer-protection law that cannot lawfully be excluded or reduced by contract. Where local mandatory law gives the customer greater rights than this Policy, those mandatory rights prevail.
Nothing in this Policy limits the statutory legal guarantee or other mandatory remedies available for goods that are defective, damaged, incorrectly supplied or otherwise non-conforming.

WARRANTY POLICY

This Warranty Policy applies to Studio96 watches purchased from studio96watches.com. It sets out the terms of the voluntary Studio96 commercial warranty and explains its relationship with mandatory statutory legal-guarantee and conformity rights. The commercial warranty is additional to, and does not replace, any rights that cannot lawfully be excluded or reduced under applicable consumer law.
1. Commercial warranty period and statutory legal guarantee
Studio96 provides the original purchaser with a 12-month limited commercial warranty beginning on the date of delivery. The commercial warranty covers qualifying manufacturing and assembly defects that materially affect the watch's functionality or conformity with the agreed Studio96 specification, subject to the exclusions and claim procedure below.
For consumers protected by EU law, the Studio96 commercial warranty exists in addition to the statutory legal guarantee of conformity. EU consumers benefit from at least two years of legal-guarantee protection from delivery, and national law may provide longer or additional protection. Statutory remedies are provided by the seller free of charge where the legal conditions for lack of conformity are met.
A claim falling outside the 12-month Studio96 commercial-warranty period may therefore still qualify under applicable statutory consumer law. Nothing in this Warranty Policy shortens a mandatory legal-guarantee period or makes the commercial warranty the consumer's exclusive remedy.
2. What the Studio96 commercial warranty covers
Subject to inspection and the exclusions in Section 3, the commercial warranty covers manufacturing or assembly defects affecting, where applicable:
· the NH35 automatic movement and its normal operating functions;
· case, crown and caseback construction;
· dial, indices and hand fitting or assembly;
· date-display operation and assembly;
· bracelet and clasp assembly where the issue results from a manufacturing defect rather than wear, sizing or misuse; and
· other faults caused by defective materials, production or assembly that materially affect normal use of the watch.
The existence of the commercial warranty does not guarantee that a watch will remain cosmetically unchanged through normal use, nor does it convert normal characteristics of a mechanical watch into defects.
3. What the Studio96 commercial warranty does not cover
To the fullest extent permitted for a voluntary commercial warranty, the following are excluded unless the issue is itself caused by a covered manufacturing defect:
· normal wear and tear, including scratches, scuffs, dents, polishing marks, bracelet wear, clasp wear and cosmetic ageing;
· damage caused by impacts, drops, crushing, accidents, improper handling, abuse, negligence or failure to use reasonable care;
· damage caused during bracelet sizing, link removal or adjustment by the customer or a third party;
· damage or malfunction resulting from the case, crown, caseback or movement being opened, modified, serviced or repaired by an unauthorised third party;
· damage caused by replacement or modification of components not approved by Studio96;
· water or moisture damage caused by exposure inconsistent with the stated 3 ATM water-resistance rating or product instructions, including immersion, swimming, showering or other water exposure not expressly represented as suitable;
· water ingress where the crown was not properly secured or where seals or the case were previously opened or damaged by an unauthorised party;
· loss, theft, fire, chemical exposure, extreme temperature, strong magnetic exposure or other external causes not attributable to production or assembly;
· normal rotor sound, winding sensation or other ordinary characteristics of an automatic mechanical movement;
· normal mechanical timekeeping variation within the movement manufacturer's stated tolerance or the accuracy range disclosed by Studio96;
· a watch stopping after its available power reserve has been exhausted, or performance caused by insufficient winding or wear time rather than a defect; and
· minor differences in perceived colour, reflectivity or appearance caused by lighting, viewing angle or display calibration where the delivered components and configuration are otherwise correct.
These exclusions govern the voluntary Studio96 commercial warranty only. They do not exclude a statutory claim where applicable law determines that the product lacks conformity.
4. Starting a warranty or legal-guarantee claim
To request assistance, contact info@studio96watches.com and provide the order number, a clear description of the issue and reasonable supporting evidence. Clear photographs should be supplied for visible issues. For movement, timekeeping or other functional complaints, Studio96 may request a short video or other reasonable evidence demonstrating the reported behaviour.
Studio96 may request photographs of the watch, packaging and relevant components, configuration/build information, delivery records, or return of the watch for physical inspection. Customers should not open, disassemble or attempt to repair the watch before the claim has been assessed, as doing so may affect commercial-warranty eligibility and may make it harder to determine the cause of the issue.
Reasonable evidence requests are intended to identify the cause and appropriate remedy. They do not remove or restrict a mandatory statutory right where the customer is otherwise entitled to that right.
5. Return shipping and responsibility for inspection
Where a defect or lack of conformity covered by mandatory consumer law is established and return of the watch is necessary, Studio96 will bear the necessary return costs as required by applicable law. For a claim accepted under the Studio96 commercial warranty, Studio96 will reimburse reasonable agreed return shipping costs or provide other return arrangements at its discretion.
If inspection shows that the reported condition results from an exclusion in Section 3 and no statutory remedy applies, the customer may be responsible for return shipping, diagnostic, repair and reshipment costs. Studio96 will communicate any chargeable work before proceeding.
International returns may require customs documentation. Customers must follow the return instructions supplied by Studio96 and must not send warranty returns to a production, assembly or logistics partner unless specifically instructed in writing.
6. Remedies and processing time
For a valid claim under the Studio96 commercial warranty, Studio96 may, at its option and subject to the circumstances of the defect: (a) repair the watch or affected component; (b) replace the watch or affected component with the same or a functionally equivalent item; or (c) issue an appropriate refund where repair or replacement is not reasonably appropriate.
Commercial-warranty repairs and replacements will be completed within a commercially reasonable period, typically within 30 calendar days after the watch is received for inspection, subject to component availability, transport and production requirements. This is an estimate rather than a guaranteed completion date.
Where mandatory legal-guarantee rights apply, statutory remedies take precedence. Under applicable EU rules, repair or replacement must be provided free of charge, within a reasonable period and without significant inconvenience. Price reduction or termination/refund may be available in the circumstances provided by law, including where repair or replacement is unavailable, disproportionate, unsuccessful or not completed appropriately.
Any approved refund will normally be issued to the original payment method. The customer's bank, card issuer or payment provider may require additional time to post the funds.
7. Repairs, replacement parts and service partners
Warranty inspection, servicing and repair may be performed directly by Studio96 or by selected technical, production or service partners acting to Studio96 specifications. Studio96 may determine the appropriate service location based on the nature of the issue, component availability and logistics.
For a commercial-warranty repair, Studio96 may use new or functionally equivalent service components appropriate to the watch. Replaced components may be retained by Studio96 or the service partner where permitted by law. Any statutory requirements applicable to a legal-guarantee remedy remain unaffected.
8. Inspection and claim determination
Studio96 may photograph, video-record and inspect a returned watch and compare its condition with the order configuration, build records, production or QC information, pre-dispatch material where available, carrier records and customer communications.
The inspection report forms the principal basis for Studio96's determination of eligibility under the voluntary commercial warranty. If a commercial-warranty claim is declined, Studio96 will explain the reason and may offer a chargeable repair or other goodwill solution where appropriate.
A Studio96 inspection does not make mandatory statutory rights subject to Studio96's sole discretion. Customers may provide additional evidence, and legal-guarantee rights remain governed by the applicable law.
9. Transferability, third-party components and limitations
The 12-month Studio96 commercial warranty is provided to the original purchaser and is non-transferable unless Studio96 agrees otherwise in writing. This limitation applies only to the voluntary commercial warranty and does not determine rights that may arise independently under mandatory law.
Studio96 watches may incorporate components manufactured by third parties, including the NH35 automatic movement. The finished watch is a Studio96 product and the Studio96 commercial warranty is administered by Studio96. Any separate manufacturer guarantee attached to an individual component is independent and does not replace Studio96's obligations as seller under applicable consumer law.
To the fullest extent permitted by applicable law, Studio96 is not liable under this voluntary commercial warranty for indirect, incidental, consequential or special losses. No limitation in this Policy applies where such limitation is prohibited by mandatory law.
10. Evidence retention and payment disputes
Customers should retain their order confirmation, configuration details, photographs or videos of the reported issue, shipping receipts, return tracking and Studio96 communications. Studio96 may likewise retain order records, configuration data, QC or production records, inspection photographs, return records and correspondence for claim administration and dispute handling.
If a payment dispute or chargeback is filed in connection with a warranty issue, Studio96 may provide relevant documentation to the payment provider or card network, including delivery evidence, the agreed configuration, claim correspondence, inspection findings, repair or replacement records, and evidence of any remedy offered or completed.
A payment dispute does not create a separate warranty or refund entitlement where the underlying contractual or statutory conditions for the requested remedy are not met.

This Warranty Policy must be read together with the Studio96 Return & Refund Policy, Shipping Policy, Terms of Service and Legal Notice. Where a mandatory consumer rule conflicts with this Policy, the mandatory rule prevails.
